Jermaine pushed Austrie and she fell in a sitting position, then he proceeded to choke her.During the choking which occurred on about five occasions, she informed police that she felt weak and her vision became blurry at one time.He threatened her by saying, “I will kill you…I stabbing you, I stabbing you with the scissors.”In his defence, he told the court he tried speaking with Austrie in a civilized manner and tried to calm her down but she kept on acting aggressively. He said it was Community Day of Service and they went into town separately so when she tried contacting him to bring the keys to open the house, he was unaware that his phone was ringing. He told the court he tried approaching her on several occasions “begging her to calm down” but she kept pushing him away.He said it was when he bounced against a wall after she pushed him he held her hands. “I whisper in her ears I love you,” he said and told the court that he did not choke or punch her. However, Magistrate Lewis said based on the medical form there was certainly a lot of physical contact. The medical report stated that she was seen by the doctor, had a swollen right upper lip and numerous red marks accompanied by swelling on her face.“I have a very dim view of men who beat women,” the Magistrate told Jermaine. He was spared a custodial sentence because his previous convictions dated back ten years ago when he was a juvenile. Therefore, he was fined $1200 on the charge of battery to be paid in full by 31 January 2014 or in default of which he will spend five months in prison. On the charge of threats he was fined $600 to be paid by 31 May 2014 or in default he will spend six weeks in prison.Austrie declined compensation from the court as she stated that Jermaine is unemployed but asked that he be warned to stay away from her for the rest of his life as their relationship is over.Dominica Vibes Newslast_img
